Welcome to AY9 Architects (“AY9”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of AY9architects.com (the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1) About this Website

The Website is provided to share information about AY9 Architects, our work, design philosophy, services, and to enable you to contact us for inquiries. Any services we provide for a specific project are delivered only under a separate written agreement (a “Project Agreement”).

2) Eligibility and Use

You agree that you will:

  • Use the Website only for lawful purposes.

  • Not attempt to disrupt, damage, or gain unauthorized access to any part of the Website, server, or networks.

  • Not scrape, crawl, or harvest content or data from the Website using automated tools without our prior written permission.

  • Not upload or transmit any malware, harmful code, or abusive content through the Website.

We may restrict or block access to the Website if we believe your use violates these Terms or applicable law.

3) No Professional Advice Through the Website

Information on the Website is general in nature and for informational purposes only. It does not constitute architectural, engineering, legal, financial, or safety advice.

Any guidance, suggestions, budgets, timelines, feasibility inputs, or concept ideas shared via the Website, email, WhatsApp, phone, social media, or early discussions are indicative only and are not binding unless included in a signed Project Agreement.

4) Inquiries, Submissions, and Materials You Share

When you contact us or submit information (including drawings, images, reference links, requirements, measurements, site details, budgets, or personal information), you represent that:

  • You have the right to share it, and it does not violate anyone else’s rights.

  • The information is accurate to the best of your knowledge.

You grant AY9 a limited right to use your submitted material solely for the purpose of responding to your inquiry, evaluating feasibility, preparing proposals, and—if you engage us—performing services.

Please do not share confidential or highly sensitive information unless and until we confirm the appropriate channel and protections in writing.

5) Proposals, Fees, and Engagements

Any proposal, fee estimate, scope, or timeline shared before signing a Project Agreement is:

  • Non-binding and subject to change after site review, survey/measurements, structural/electrical/plumbing inputs, statutory constraints, vendor quotes, and client decisions.

  • Valid only for the period stated in the proposal (if any), otherwise it may be withdrawn or revised at any time.

Actual services, deliverables, payment schedules, revisions, approvals, consultants, procurement, and execution responsibilities will be governed by the Project Agreement.

6) Third-Party Consultants, Vendors, and Site Execution

Architecture projects often involve third parties such as structural consultants, MEP consultants, landscape specialists, contractors, vendors, fabricators, and government authorities.

Unless we explicitly agree in writing:

  • We do not guarantee the performance, pricing, timelines, or quality of any third-party.

  • We are not responsible for delays, cost overruns, defects, or failures caused by third parties, force majeure events, or authority approvals.

If we recommend any third party, it is based on professional experience and availability at the time, not a warranty.

7) Intellectual Property

All content on the Website—including text, designs, drawings, concepts, renders, photographs, graphics, layouts, and brand assets—is owned by or licensed to AY9 and protected by intellectual property laws.

You may view and use the Website for personal and non-commercial purposes. You may not:

  • Copy, reproduce, republish, distribute, publicly display, or create derivative works from the Website content without our prior written permission.

  • Use our name, logo, or project images to imply endorsement or association.

Project imagery note: Some images may be conceptual, staged, edited, or represent design intent. Site conditions, materials, and outcomes may vary.

8) Portfolio and Publicity

Unless a Project Agreement states otherwise, AY9 may document and display completed or ongoing project work (including photographs, renders, and descriptions) for portfolio, awards, publications, website, and social media—while taking reasonable care to avoid publishing sensitive personal details.

If you have privacy concerns for a specific project (e.g., residence security), this must be agreed in writing as part of the Project Agreement.

9) Testimonials

Any testimonials or client quotes on the Website reflect individual experiences and may not represent typical outcomes. Project results vary depending on scope, site, approvals, budgets, and third-party execution.

10) Links to Other Websites

The Website may contain links to third-party websites (for example, publications, vendors, or social platforms). We are not responsible for third-party content, policies, or practices. Your use of third-party sites is at your own risk.

11) Disclaimer of Warranties

The Website is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, AY9 disclaims all warranties, express or implied, including accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Website will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

12) Limitation of Liability

To the maximum extent permitted by law:

  • AY9 will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, business, goodwill, data, or opportunities) arising from or related to your use of the Website.

  • AY9’s total liability for any claim related to the Website shall not exceed INR 10,000.

Nothing in these Terms limits liability that cannot be limited under applicable law.
